My Opposition to Convicted Terrorist Brett Kimberlin’s Knowingly Frivolous Motion to Strike my Motion to Dismiss

This is the latest post in what I half-jokingly call The Kimberlin Saga®.  If you are new to the story, that’s okay! Not everyone reads my blog.  The short version is that convicted terrorist Brett Kimberlin has been harassing me for over three years, his worst conduct being when he attempted to frame me for a crime.  I recognize that this might sound like an incredible claim, but I provide video and documentary evidence of that fact; in other words, you don’t have to believe my word.  You only have to believe your eyes.  Indeed, he sued me for saying this and lost on the issue of truth.  And more recently when his wife came to us claiming that this convicted terrorist had threatened her harm, we tried to help her leave him, and for that, he sued myself, John Hoge, Robert Stacy McCain and Ali Akbar for helping his wife and he is suing Hoge, McCain, Akbar, DB Capital Strategies, Michelle Malkin, Glenn Beck, Patrick “Patterico” Frey, Mandy Nagy, Lee Stranahan, Erick Erickson, Breitbart.com, the Blaze, Mercury Radio Arts, Red State, the National Bloggers Club, and  others alleging that we are all in organized crime for reporting factually about the spate of SWATtings committed against myself, Frey and Erickson.  So, if you are new to the story, go to this page and you’ll be able to catch up on what has been happening.

I didn’t plan it this way, but this is turning into an embarrassment of riches this week in the latest lawsuit Brett Kimberlin has filed against me.  Yesterday, I shared with you Kimberlin’s latest dumb motion to dismiss and delved deeper into his psyche (shiver).  Today I share my official opposition to his motion to strike.  That is separate from my motion to strike, because where the motion to strike was based on his failure to provide service, this is based on the merits, or lackt thereof, don’t worry, dear reader, it is popcorn-worthy.™  I mean there isn’t really much to say about whether I can 1) file a MTD immediately, or 2) represent myself, but there is a lot to say about how wrong the Plaintiff is to even raise the argument.  So... enjoy:


As per usual, it is the same thing I filed except 1) it is not signed or notorized and 2) some personal information has been redacted.  And since I had more time to respond, I mailed it, instead of driving up there and filing it.

Now, yesterday I delved deep into Brett Kimberlin’s psyche, to see what might be driving some of his unique hatred of me.  But it only seems fair to ask, well, why do I dislike him?  Is it some trauma or some aspect of growing up?

Well, yes.  For instance, I dislike terrorists because of an incident you might have heard of around fourteen years ago.  You see, on September 11, 2001, terrorists attacked my country and, while I was never a fan of them to start, those events cemented my belief that terrorists are some of the scummiest people on earth.

And why do I like free speech and hate every attempt to suppress it by violence?  Well, it comes from how I was raised.  You see, every morning my class would say:

I pledge Allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, indivisible, with Liberty and Justice for all.

Also I was influenced by documents such as the Declaration of Independence, and even the Constitution and the Bill of Rights.  Over time, I was equally influenced by the words of Abraham Lincoln and John Locke (the philosopher, not the character on Lost, though he was pretty cool, too), along with other sources.

And why do I hate pedophiles?  I may not have any children of my own, but most people have young girls in their families that we love and want to see protected, and recoil at the thought of some old pervert feeling lust toward them, let alone hurting them.  And because f—k pedophiles.

On top of that, I am not particularly pleased with how he has exhibited bigotry toward my friends, my wife and I, or how he stalked my wife, or how he tried to frame me for a crime, to name a few issues.

In other words, for me this isn’t about psychological needs, or hang ups, unless you think 1) hating terrorism, 2) loving free speech, 3) hating pedophiles, 4) hating bigotry (including racism), 5) opposition to actual stalking, or 6) anger at an attempt to put you in prison for a crime you didn’t commit, are based on “hang ups.”

As for my stubborn unwillingness to bend...  let’s just say that if you are born with a disability that makes you write four times slower than most people when you print, twelve times slower when you attempt to write in cursive... you learn how to persevere.*

Anyway, as for the rest of the week, it is worth taking a time to set up events.  Tomorrow, we will have a hearing in what I am now referring to as K. Kimberlin v. Hoge, where Brett is again trying to use his daughter to silence John (unlike Brett, I do not do things that puts his daughter’s name in the press next to his).  And on the same day, I will file... something to make the case go smoother.  Bluntly, dear reader, you should not expect something popcorn worthy at all.  I am likely to share that with you Friday.

And at the same time, Brett’s responses will start to be due.  So we will see what, if anything, he ends up filing.

So lots to report on, dear reader.  Just keep stocking up on popcorn.

* Readers with long memories might remember that the disability I am discussing, dysgraphia, in my case does not affect my typing skills.  Which means I was born in almost at the right time, but not quite there.  Why do I say that?  Because laptop computers were not a realistic option until after I dropped out of high school due to disability discrimination, and after enrolled in college about four years later than I probably would have, otherwise.  Once I had my first laptop computer, my long-dormant potential was unlocked.

That last sentence admittedly might sound arrogant, but to me it just is something I observed in my lifetime.  I mean, if Helen Keller told you that she had felt like her potential was locked up until she was finally able to learn to read and learn sign language by the teachings of Anne Sullivan, you wouldn’t call that arrogant: you would call that simply an accurate description of what happened.  What potential I had, was locked behind disabilities that severely limited my ability to express myself in writing (my mouth, on the other hand, always worked fine, to the chagrin of many).

But key to my story, is that I didn’t have any of that until I was twenty two years old.  The rest of my life, up until then, was spent forcing myself to do something that required more determination than most people have to exert.  At my wedding, the best man said I was the most stubborn person he ever knew, but I made that a virtue.  He said I would stubbornly stand by wife no matter what, as I would my friends.  It has always been humbling to me to see how stubbornly they stood by me, too.

As I jokingly say, “John Adams said ‘facts are stubborn things.’  Well, so am I.”

Disclaimer:

I have accused some people, particularly Brett Kimberlin, of reprehensible conduct.  In some cases, the conduct is even criminal.  In all cases, the only justice I want is through the appropriate legal process—such as the criminal justice system.  I do not want to see vigilante violence against any person or any threat of such violence.  This kind of conduct is not only morally wrong, but it is counter-productive.

In the particular case of Brett Kimberlin, I do not want you to even contact him.  Do not call him.  Do not write him a letter.  Do not write him an email.  Do not text-message him.  Do not engage in any kind of directed communication.  I say this in part because under Maryland law, that can quickly become harassment and I don’t want that to happen to him.

And for that matter, don’t go on his property.  Don’t sneak around and try to photograph him.  Frankly try not to even be within his field of vision.  Your behavior could quickly cross the line into harassment in that way too (not to mention trespass and other concerns).

And do not contact his organizations, either.  And most of all, leave his family alone.

The only exception to all that is that if you are reporting on this, there is of course nothing wrong with contacting him for things like his official response to any stories you might report.  And even then if he tells you to stop contacting him, obey that request.  That this is a key element in making out a harassment claim under Maryland law—that a person asks you to stop and you refuse.


And let me say something else.  In my heart of hearts, I don’t believe that any person supporting me has done any of the above.  But if any of you have, stop it, and if you haven’t don’t start.

  1. How does he manage to keep filing lawsuits like this? Does this mean that there are still some Maryland judges that he has not managed to totally piss off?

  2. Mr. Walker, as a legal professional and having read many of your pleadings, you write very well. However, I would suggest one tiny change which will make the reading of your pleadings easier. Instead of writing "the plaintiff," just say, "plaintiff," leaving out "the." IMO legal pleadings read smoother that way.

    Very much enjoy your blog and wish you and yours all good things.
